1. Acceptance of Terms
By accessing or using the deepskydiscovery.space website (the “Site”) or booking a program through Deep Sky Discovery (“Deep Sky Discovery,” “we,” “us,” or “our”), you agree to these Terms of Use. If you do not agree, please do not use the Site or book a program.
2. Description of Services
Deep Sky Discovery provides astronomy outreach and event programming, including private events, corporate programs, community and educational programs, hospitality/resort programs, and free public street astronomy events, throughout Northern Illinois, Southern Wisconsin, and the surrounding Midwest. Program availability, pricing, and content are subject to change without notice.
3. Bookings, Proposals, and Payment
• Website inquiries are requests for a proposal, not confirmed bookings.
• A booking is confirmed only upon a signed written agreement and receipt of any required deposit.
• Pricing shown on the Site is a starting point; final pricing depends on location, duration, staffing, travel, and equipment needs and will be set out in a written proposal or contract.
• Cancellation, rescheduling, and weather-related policies will be set out in the event contract, not in these Terms.
4. Weather and Event Modifications
Outdoor astronomy programs are inherently weather-dependent. Deep Sky Discovery reserves the right to delay, relocate, modify, or cancel any event due to weather, safety, or site conditions, in accordance with the terms of the applicable event contract.
5. User Conduct
You agree not to use the Site to submit false or fraudulent booking requests, to interfere with the Site's operation, or to use any content from the Site for unauthorized commercial purposes.
6. Intellectual Property
All text, graphics, logos, photographs, and other content on the Site are the property of Deep Sky Discovery or its licensors and may not be copied, reproduced, or distributed without written permission.
7. Photography and Media
Deep Sky Discovery may photograph or record public and private events for marketing purposes, subject to the photography terms set out in the applicable Event Liability Waiver and Photography Release, and subject to any client instruction to the contrary that is agreed in writing in advance.
8. Disclaimer of Warranties
The Site and its content are provided “as is” without warranties of any kind, express or implied, including as to accuracy, availability, or fitness for a particular purpose. Viewing conditions, celestial visibility, and weather cannot be guaranteed.
9. Limitation of Liability
To the fullest extent permitted by law, Deep Sky Discovery shall not be liable for any indirect, incidental, special, or consequential damages arising from use of the Site. Liability related to in-person events is governed separately by the Event Liability Waiver and the applicable event contract, and by Illinois or Wisconsin law depending on where the event takes place.
10. Third-Party Links
The Site may link to third-party websites (for example, weather or astronomy resources). Deep Sky Discovery is not responsible for the content or practices of any third-party site.
11. Privacy
Information submitted through inquiry and booking forms is used to respond to requests and manage the customer relationship, and is handled in accordance with Deep Sky Discovery's Privacy Policy. Client contact information and event details are not sold to third parties.
12. Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles, except where an event contract for a Wisconsin event specifies otherwise.
13. Changes to These Terms
Deep Sky Discovery may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
